Murmur is an anonymous social benchmarking app. Users answer questions and compare aggregate results across the broader community, communities, friends, and groups.

You must be at least 13 years old to use Murmur.

By using Murmur, you represent that:

• You are at least 13 years old.
• You are legally allowed to use the Service.
• You will follow these Terms and all applicable laws.
• The information you provide to us is accurate and up to date.

If you are under the age of majority where you live, you may use Murmur only with permission from a parent or legal guardian.

Murmur may tailor questions, feeds, communities, features, visibility, or access based on age, safety, moderation, product integrity, or legal requirements. Some questions or features may not be appropriate or available for all users.

You may need an account to use some or all of Murmur. You are responsible for maintaining the security of your account and for activity that occurs through your account.

You agree not to:

• Create an account using false, misleading, or unauthorized information.
• Use another person’s account.
• Share your account in a way that creates risk or abuse.
• Attempt to bypass limits, voting rules, anonymity protections, or security features.

We may suspend or terminate accounts that violate these Terms, create risk, abuse the Service, or interfere with other users’ experience.

Murmur is designed so that your answers are shown anonymously to other users.

This means other users should not see your individual answer attached to your name, username, email, or profile.

However, Murmur is not designed to make your activity impossible for Murmur to process, moderate, debug, secure, or enforce. We may maintain backend records needed to:

• Operate the Service.
• Enforce voting rules.
• Prevent duplicate voting, manipulation, spam, fraud, and abuse.
• Debug technical issues.
• Provide results, streaks, history, notifications, and app functionality.
• Protect Murmur and its users.
• Comply with legal obligations.

You should not use Murmur to submit information that you are not comfortable having processed by the Service under these Terms and our Privacy Policy.

Murmur may include daily questions, user-submitted questions, communities, friends, private groups, and result breakdowns.

You understand and agree that:

• Results may change as more users answer.
• Some result slices may be hidden until enough people answer.
• We may apply minimum thresholds before showing group, friend, community, or other segmented results.
• We may remove, edit, reject, or moderate questions, options, submissions, groups, comments, or content.
• We may choose which submitted questions appear in the app.
• We may limit, delay, or restrict results to protect safety, privacy, quality, or product integrity.
• We may tailor questions, feeds, or features based on age, safety, moderation, or product integrity.
• We may test, change, or discontinue features.

Murmur results are provided for social, entertainment, and general informational purposes only. They are not professional, medical, legal, financial, psychological, or other expert advice.

You may submit content to Murmur, including questions, answer options, reports, feedback, group names, profile information, and other materials (“User Content”).

You retain ownership of your User Content, but you grant Murmur a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, edit, publish, display, distribute, analyze, create derivative works from, and otherwise use your User Content to operate, improve, promote, and develop the Service.

This license allows us to do things like:

• Display submitted questions.
• Edit questions or answer options for clarity, safety, grammar, length, or quality.
• Use questions in future daily prompts or community prompts.
• Analyze usage and answer trends.
• Create aggregate or de-identified insights.
• Promote Murmur using non-identifying examples or summaries.

You represent that you have the rights needed to submit your User Content and that your User Content does not violate these Terms or anyone else’s rights.

You agree not to use Murmur to:

• Harass, threaten, bully, abuse, or target others.
• Submit hateful, violent, sexually exploitative, illegal, or harmful content.
• Share private or sensitive information about another person without permission.
• Dox, identify, expose, or attempt to identify anonymous users.
• Manipulate votes, results, streaks, groups, invites, or engagement.
• Create fake accounts or use bots, scripts, automation, or scraping.
• Reverse engineer, attack, overload, or interfere with the Service.
• Circumvent privacy, security, moderation, or access controls.
• Use Murmur for unlawful, deceptive, or unauthorized commercial purposes.
• Submit content that infringes intellectual property, privacy, publicity, or other rights.

We may remove content, restrict features, suspend accounts, or take other action if we believe these rules have been violated.

Murmur may allow users to create or join private groups, friend networks, or invite-based experiences.

Private groups are intended to limit visibility within the product, but they are not a guarantee that information will remain secret. Group members may be able to infer information from context, screenshots, timing, small group sizes, or what others share outside Murmur.

You agree not to use private groups or invites to harass, pressure, expose, identify, or target others.

Murmur may collect and analyze information about how people use the Service, including answer patterns, engagement, result views, communities, groups, and app activity, as described in our Privacy Policy.

Murmur may use, publish, license, sell, or otherwise commercialize aggregated, de-identified, statistical, or non-identifying insights derived from use of the Service, provided those insights are not intended to identify an individual user.

For example, Murmur may create or commercialize insights about broad trends, percentages, comparisons, or patterns across groups of users.

Murmur will not intentionally provide buyers or partners with your name, email address, username, raw identifiable answer history, private friend graph, private group membership, or other information intended to identify you as an individual, except as described in our Privacy Policy or with your consent.

If you send us ideas, suggestions, bug reports, feature requests, or other feedback, you grant us the right to use that feedback without restriction or compensation to you.

Murmur, including our name, branding, design, software, features, content, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not give you ownership of Murmur or any rights except the limited right to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Murmur except as allowed by law or with our written permission.

Murmur may rely on third-party providers to operate the Service, including hosting, authentication, database, analytics, email, notification, infrastructure, and security providers.

Your use of Murmur may involve third-party services, links, or integrations. We are not responsible for third-party services that we do not control.

We may update, modify, suspend, or discontinue any part of Murmur at any time. We may also add or remove features, impose limits, or change how results, communities, groups, friends, or questions work.

You may stop using Murmur at any time.

We may suspend or terminate your access to Murmur if we believe you violated these Terms, created risk, caused harm, abused the Service, or if we discontinue the Service.

After termination, some provisions of these Terms will continue to apply, including sections related to User Content licenses, aggregated insights, disclaimers, limitations of liability, and dispute terms.

Murmur is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and security.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free.
• Results will be complete, accurate, representative, or statistically valid.
• Anonymity protections will prevent every possible inference or disclosure.
• Content will always be available.
• Bugs, errors, or misuse will never occur.

Use Murmur at your own risk.

To the fullest extent permitted by law, Murmur and its owners, operators, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or other intangible losses.

To the fullest extent permitted by law, our total liability for any claim relating to the Service or these Terms will not exceed the greater of:

• The amount you paid to Murmur in the 12 months before the claim, or
• $100.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Murmur and its owners, operators, employees, contractors, service providers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

• Your use of the Service.
• Your User Content.
• Your violation of these Terms.
• Your violation of law or another person’s rights.
• Your misuse of Murmur or attempt to interfere with the Service.

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using Murmur, you agree to our Privacy Policy.

We may update these Terms from time to time. If we make material changes, we may notify you through the Service, by email, or by other reasonable means.

Your continued use of Murmur after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using Murmur.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, unless applicable law requires otherwise.
